What is a Qualified Written Request?

A Qualified Written Request, or QWR, is an official letter sent by a mortgage borrower to their mortgage servicer in case of an error or to request information about their account. The mortgage servicer is the company that processes monthly mortgage payments, which may be different from the one where the borrower originally obtained the loan.

Reporting Errors Through a Qualified Written Request

Under the Real Estate Settlement Procedures Act, borrowers have the right to report various errors using a QWR. These errors include failing to process payments correctly, imposing unreasonable fees, providing inaccurate information about foreclosure options, and violating foreclosure processes. The aim of a QWR is to correct errors and ensure proper servicing of the loan.

How to Use a Qualified Written Request

When sending a QWR, borrowers should find the correct address for their mortgage servicer and include their name, loan details, and specific information requested. Once the servicer receives the QWR, they must acknowledge receipt within five days and provide a response within 10 to 30 days, depending on the information requested. There is no set template for a QWR, as it will vary depending on the specific situation.

Submitting a Qualified Written Request

Any borrower can submit a QWR without incurring any fees. The letter should outline the error or information requested, along with personal details like name, address, and loan number. Before sending a QWR, borrowers should ensure they have the correct address for their servicer, as each company may have a designated location for receiving these requests.
